Minnesota Government Data Practices and Privacy Law
Data privacy and the protection of personal information are becoming more and more important as technology continues to grow. You may be surprised to know that the government is perhaps the largest holder of personal information about you. This begs the question what does the government do to protect the privacy of information and data that it holds on me? Unfortunately the answers is sometimes not enough.

Over the past few months, many high-profile cases have highlighted the vulnerability of private data held by government agencies against the unauthorized use of the state Driver and Vehicle Services database by employees with access to the records. These cases highlight difficulty that state agencies are having in enforcing the law and procedures designed to protect the security of your data. State officials have pledged to beef up their training and internal policies to safeguard data, but continued misuse of state databases by law enforcement and agency employees may still occur.

What do can you do if you receive notice from a government agency that your data has been breached? Minnesota laws (collectively the Minnesota Data Practices Act) outline the procedures available to you if the breach results in any harm, and provides remedies available to correct those harms. Additionally, federal law provides additional recourse for individuals whose driver’s license information has been improperly accessed or used. If you have received notice that your information has been breached, contact Listug Law Office to discuss the legal options available to you for this violation. Attorney Dan Listug can help you exercise your rights under the law when the government fails to protect your personal information.  Call today at 763-260-4015.

Another key tenant to our democratic system is the requirement that all meetings of public bodies where public business may be conducted must comply with Minnesota’s Open Meeting Law. Increased use of email and other social media functions can create potential violations in the law by members of such boards and elected officials. Listug Law Office is available to consult with public bodies concerned about compliance with the law. Additionally, we serve individuals or groups who feel that a public body has acted in violation of the law.  Contact us today to discuss your rights under the law.

The Government Data Practices Act also governs the public’s right to access data held by the government. As a core tenant of our democracy, all data collected by the government is presumed to be public unless the data is defined in law or rule as nonpublic or protected. Access to public data provides individuals and organizations with the tools needed to keep governments accountable and their actions transparent. If you have questions on how to access public data, or having difficulty obtaining information for a government entity contact Listug Law Office today or call 763-260-4015 to see how we can assist you in exercising your rights to this information.
